Following the recent publication of a statutory instrument dated April 9, 2018, granting a number of customs duty concessions to Sandals Resorts International Group, backdated to April 15, 2013, the issue was debated in the Saint Lucia parliament on Tuesday.
Former Prime Minister Dr Kenny Anthony, questioned in particular the authority under which the concessions were backdated to take retroactive effect from April 15, 2013, for a 15-year period terminating on April 14, 2028, except in respect of construction equipment, which is applicable for a period of five years, commencing from April 15, 2013, and terminating April 14, 2018, i.e. after the order had been Gazetted on April 23, 2018. “How is that applicable, backdated by five years and yet if you look at the exercise of the powers, it says; in exercise of the powers conferred under the section 35 and 13 of the Tourism Incentives Act… where in this act does that authority exist to do this? You can only do this, if of course you turn to the amending act and decided to backdate the concessions in accordance to that amending act,” he said.
