Judgement was delivered in this case from Dominica where an appeal involving a dispute on the sale of two parcels of land owned by Mr. Angel Peter Andrew under a power of attorney granted to his sister, Gloria Shillingford, and payment allegedly made by her in relation to the lands, including certain payments made by Gloria to two connected parties. Attorney Jody Luke of Lennox Laurence Chambers appeared for the appellant, and Attorney Michael Bruney appeared for the respondent. The appeal was against concurrent findings of fact by the Trial Judge Mr. Justice Cottle. The court found that the Dominant issue of law in the courts was that Gloria Shillingford has no Authority to engage Hillary and grant him the exclusive right to sell their lands for a period of six months. The courts applied the Maxim ‘delegatus non-protest delegate', whereby a delegate cannot delegate,&found that the power of attorney given to Gloria had given her no authority to make the exclusive agreement with Hillary. The courts therefore dismissed the appeal and affirmed the decisions of the courts and ordered that Gloria Pay Angel Basic Costs. Summary Judgement read by Justice Barrow.
