Dominica Local Government Commissioner Glenroy Toussaint defends Mrs Avis Edwards, who was fired by the LaPlaine/La Ronde Village Council, on grounds of misconduct
In response to a document dated 16th June 2020, confirming the termination of Former Interim Clerk from the LaPlaine/La Ronde Village Council Mrs. Avis Edwards, approved by the Council’s Chairman Mr. Frantz Saint Jean, Commissioner of Dominica’s Local government Glenroy Toussaint is attempting to defend Mrs. Avis Edwards, who is the wife of Agriculture Minister Kent Edwards.
Glenroy Toussaint claims the following; The reasons outlined for the termination of the employment of the Interim Clerk based on advice from the Labour Division cannot be Serious Misconduct which warrants termination of employment. He argues this is a situation which can be improved with clear instructions and collective commitment.
Toussaint added that section 6 Subsection (a) and (b) of the “Protection of Employment Act Chapter 89:02 of the Revised laws of Dominica, provides guidance on how matters of misconduct which are not serious in nature should be dealt with. The act states: “Where an Employee is guilty of misconduct in or in relation to her employment which, while not sufficiently serious to permit her employer to terminate her employment pursuant to section 5, is of such nature that the employer cannot reasonably be expected to continue to employ the employee if such misconduct is repeated. The employee shall give the employer a written warning.”
Toussaint claims he is not aware that any written warning was issued to the Interim Clerk outlining the misconduct or unsatisfactory performance prior to the issuance of the letter of termination.
