71-year-old Vivian Nichols pleaded guilty to two (2) counts of sexual intercourse with a minor, jailed for ten years

Meanwhile, 71-year-old Vivian Nichols pleaded guilty to two (2) counts of sexual intercourse with a minor, and has been jailed for ten years. The incident happened in July 2013. Nichols was 68 years old at that time’ and the child was 8 years old. He was charged with buggery and unlawful sexual intercourse.
 
The facts are that Nichols invited her into his house, held her by the hand and led her into his bedroom. He placed her on her back and proceeded to have intercourse with her. Meanwhile, the child’s six-year-old brother, upon not seeing her and knowing she had gone to get fruits, went in search of her in the yard. On arrival at Nichol’s home, he noticed the front door was closed.
 
He went under the house, looked through an opening in the floor and noticed that the door to Nichols’ bedroom was open. He looked through the door and saw Nichol’s on his sister. The boy went for his twin sister and when they returned, they saw Nichols opening the front door and their sister standing in the bedroom door.
 
They questioned her and she said, “me and Uncle Pitou was sexing.” They left and when their mother returned the brother told her what he saw. The mother immediately spoke to all three children and then went to the police. The child was examined by a medical doctor and spent 10 days as a patient at the Princess Margaret Hospital.
 
“I begging sorry for what I done…Please forgive me. First time I coming there,” Nichols told the court on Friday. The judge labeled his actions” abhorrent and cruel” and said the sentence must send a clear message.
 
Under law he must set a nominal sentence and he set both at 15 years each. Since Nichols pleaded guilty, the judge, according to law must reduce the sentence by 1/ 3 which brings it to 10 years. Nichols was sentenced to 10 years on each count to run concurrently, meaning that he will spend 10 years in jail.
