Kieron Pinard-Byrne has reportedly filed his bill of cost for assessment by the Privy Council, in the defamation matter Vs Lennox Linton.
He says this was done because no agreement was reached with Opposition Leader Lennox Linton, as retards the bill of cost submitted to him on April 21, 2016, when his attorneys DeFreitas, DeFreitas and Johnson asked Linton in writing, to agree to pay three hundred and forty thousand, nine hundred and twenty- six dollars and thirty-nine cents (($340, 926. 39) to Pinard-Byrne. That amount represented Pinard-Byrne’s costs at the Eastern Caribbean Supreme Court and Judicial Committee of the Privy Council, in keeping with its January 2016 order. The defamation suit was filed against Linton in 2002. Pinard-Byrne won at the High Court of Justice in Dominica but Mr. Linton appealed to the Eastern Caribbean Court of Appeal and won. Pinard-Byrne then appealed to the Privy Council, which was at the time Dominica’s final appellate court, and won in October 2015. Pinard-Byrne hopes the Privy Council will soon award “reasonable costs”.
